Motion by Purcell second by Voges to grant a variance of 10 feet <br /> from required setback from Maple Avenue — contingent upon access permit <br /> for the driveway to the garage being granted by the Town of Fitchburg. <br /> FINDING OF FACT: <br /> 1. Being a corner lot and because of location of septic and residence <br /> a 2 car garage could not be constructed on the property without <br /> a variance. <br /> CONCLUSION: <br /> a. Proven case of unnecessary hardship. <br /> (1, b. Variance is necessary to provide right enjoyed by others. <br /> c. 'Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried. <br /> #800. Motion by Schwahn second by Purcell to grant a variance of 3 <br /> feet from required right side yard. <br /> FINDING OF FACT: <br /> 1. Existing residence is too close to side lot line to permit a <br /> double garage without a variance. <br /> CONCLUSION: <br /> a. Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. <br /> b. Variance is necessary to provide right enjoyed by others. <br /> Motion carried. <br /> #801. Motion by Kruschke second Purcell to grant a variance of 4.6 feet <br /> from required setback from Sabaka Trail which will allow the room addi- <br /> tion to be permitted but not the deck. <br /> FINDING OF FACT: <br /> 1. Zoning permit for room addition was issued in error as Sabaka <br /> Trail was not shown on site plan. <br /> 2. Deck was constructed by owner without a zoning permit. <br /> CONCLUSION: <br /> Room Addition: a) . Proven case of unnecessary hardship. b) . Vari- <br /> ance preserves the Zoning Ordinance as much as possible without <br /> injustice to applicant. <br /> Deck Addition: a) . Constitutes a self-imposed hardship.
