Existing residence is non-conforming as to setback and is approxi- <br /> 1 mately 14 feet closer to road than the proposed residence. <br /> 2. Location other than proposed is impractical. <br /> CONCLUSION: <br /> a. Proven case of unnecessary hardship. <br /> b. Variance is not contrary to rights of others or the public <br /> interest. <br /> c. Hardship is caused by the ordinance and is not self-imposed. <br /> Motion carried. <br /> #788. Motion by Schwahn, second by Purcell to grant a variance of 1 1/2 <br /> feet from required side yard. Motion carried. <br /> #789. Motion by Voges, second by Schwahn to grant a variance of 10 feet <br /> from required rear yard. <br /> FINDING OF FACT: <br /> 1. Property is surrounded on 3 sides by Village of Black Earth. <br /> 2. Required rear yard for the properties within the Village in <br /> this area is 30 feet. <br /> 3. Topography of lot, location of existing septic and preservation <br /> of alternate septic area prevent any other reasonable location <br /> of addition. <br /> CONCLUSION: <br /> a. Proven case of unnecessary hardship. <br /> b. Variance is necessary to provide right enjoyed by others. <br /> c. Variance is not contrary to rights of others or to the <br /> public interest. <br /> Motion carried. <br /> #790. Motion by Schwahn, second by Purcell to grant a variance of 2 1/2 <br /> feet from required left side yard. <br /> FINDING OF FACT: <br /> 1. Existing gas and sewer lines prevent other location of a <br /> reasonable sized garage. <br /> 2. Location, lakeside of residence would require removal of trees. <br /> General location of garage on lake front lots is road side of <br /> residence. <br /> CONCLUSION: <br /> a. Proven case of unnecessary hardship. <br /> b. Variance is necessary to provide right enjoyed by others. <br /> c. Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried. <br /> #791. Motion by Purcell, second by Voges to deny. <br /> FINDING OF FACT: <br /> 1. According to Mr. Marble's written statement submitted for <br /> variance application and his testimony at the public hearing <br /> he; (a) . relied on information form his surveyor that was <br /> incomplete, non-existing and in error. <br />
