Determination of basic issue and special rules for public hearing <br /> of appeal #782 were discussed with Assistant Corporation Counsel Tom <br /> Creeron. <br /> The notice of public hearing was read and the hearing was opened at 8:00 <br /> p.m. <br /> 1 <br /> #782. Appeal by Dennis and Greta Zimmerman for determination of the <br /> validity of the interpretation of the Dane County Zoning Administrator as <br /> pertains to Section 10.12 (2) (a) 4 and 5 Dane County Zoning Ordinance in <br />` the issuing of a mineral extraction permit to the E.M.T. Partnership in <br /> the SE 1/4 SE 1/4 of Section 24, Town of Sun Prairie. <br /> IN FAVOR: Jackson Logan, representing the Zimmermans; John Dollard; <br /> Jim Huggett. <br /> L. J. Enger, Dane County Zoning Administrator, presented historical facts <br /> of mineral extraction provisions. <br /> OPPOSED: Attorney Dave Uphoff representing E.M.T. Corporation; Cyril <br /> Motel; Dean Evert. <br /> Ar <br /> Town Board Chairman Claude Schuster; Board is in favor of appeal. <br /> Rebuttal by J. Logan. <br /> The public hearing was closed. <br /> Motion by Voges second by Schwahn to deny the appeal. <br /> Motion by Schwahn second by Voges to direct Corporation Counsel to <br /> draft findings of fact and conclusion. Motion carried. <br /> FINDING OF FACT: <br /> 1. On March 14, 1979, a mineral extraction permit (#M79-40) was <br /> issued by the Dane County Zoning Administrator to extract sand <br /> and gravel from an area encompassing approximately 39.9 acres <br /> in the SE 1/4 of the SE 1/4 of Sec. 24 in the Town of Sun Prairie, <br /> Dane County, Wisconsin. <br /> 2. The permit was issued to EMT Partnership, the owner of the land. <br /> 3. A reclamation plan was submitted with the permit application. The <br /> reclamation plan indicates that all final slopes will be flatter <br /> than 3:1 and that topsoil will be replaced and the area transferre. <br /> to a tree farm after reclamation is complete. <br /> It <br />
