The meeting was called to order by Chairman Dahlk at 7:30 p.m. in Room #224. Determination of basic issue and special rules for public hearing of appeal #782 were discussed with Assistant Corporation Counsel Tom Creeron. The notice of public hearing was read and the hearing was opened at 8:00 p.m. 1 #782. Appeal by Dennis and Greta Zimmerman for determination of the validity of the interpretation of the Dane County Zoning Administrator as pertains to Section 10.12 (2) (a) 4 and 5 Dane County Zoning Ordinance in ` the issuing of a mineral extraction permit to the E.M.T. Partnership in the SE 1/4 SE 1/4 of Section 24, Town of Sun Prairie. IN FAVOR: Jackson Logan, representing the Zimmermans; John Dollard; Jim Huggett. L. J. Enger, Dane County Zoning Administrator, presented historical facts of mineral extraction provisions. OPPOSED: Attorney Dave Uphoff representing E.M.T. Corporation; Cyril Motel; Dean Evert. Ar Town Board Chairman Claude Schuster; Board is in favor of appeal. Rebuttal by J. Logan. The public hearing was closed. Motion by Voges second by Schwahn to deny the appeal. Motion by Schwahn second by Voges to direct Corporation Counsel to draft findings of fact and conclusion. Motion carried. FINDING OF FACT: 1. On March 14, 1979, a mineral extraction permit (#M79-40) was issued by the Dane County Zoning Administrator to extract sand and gravel from an area encompassing approximately 39.9 acres in the SE 1/4 of the SE 1/4 of Sec. 24 in the Town of Sun Prairie, Dane County, Wisconsin. 2. The permit was issued to EMT Partnership, the owner of the land. 3. A reclamation plan was submitted with the permit application. The reclamation plan indicates that all final slopes will be flatter than 3:1 and that topsoil will be replaced and the area transferre. to a tree farm after reclamation is complete. It
