IN FAVOR: Ronald Houser OPPOSED: None TOWN BOARD: Letter,
no objection. DANE COUNTY HIGHWAY: concern.
Public hearing was closed.
#714. Motion Voges second Schwahn to grant a variance of 39 1/2 feet
from the required setback from unter-line of CTH "F" .
FINDING OF FACT:
1. Existing residence is non-conforming and located within the require'
setback. Any addition to or improvement for front entry to resi-
dence would require a variance.
., CONCLUSION:
a. Proven case of unnecessary hardship.
b. Variance is necessary to provide right enjoyed by others,
c. Variance is not contrary to rights of others or to the pub-
lic interest,
Motion carried.
#715. Motion by Schwahn second by Purcell to grant a 9 foot variance fro
required setback from centerline of CTH "V" for relocation of entry and
to deny variance for addition to building.
FINDING OF FACT:
1. Relocation of entrance is not an expansion of use.
Co 2. New entry will project easterly and be in line with existing North
side of building causing no farther encroachment towards CTH V.
3. SEly addition to building would provide expansion of non-conformin•
use.
4. Other recourse, application for appropriate zoning to permit said
use, has been submitted.
CONCLUSION:
Relocation of entry - a. Proven case of unnecessary hardship. .:
b. Variance is not contrary to rights of others or to the public
interest.
Addition to building - a. Expansion of non-conforming use can be rec-
tified by appropriate zoning; no hardship proven. Motion carried.
#716. Motion by Voges second by Schwahn to grant a variance of 30 feet
from required setback from right-of-way of Syene Road.
FINDING OF FACT: •
1. Existing loading area in front of building requires trucks to
back in from the road and to be parked into the road right-of-
way. New dock will provide off road parking for loading and
unloading.
2. Dock is not feasible in location other than front of building
because of two story design of building with grade level sloping
down to lower level of building on the sides and rear.
CONCLUSION:
a, Proven case of .unnecessary hardship.
4:: b. Variance is not contrary to rights of others or to the public
interest and provides improved traffic safety.
CONDITIONS:
1. Parking of vehicles or loading, unloading of trucks is not
permitted on the Syene Road side of the dock.
