BOARD OF ADJUSTMENT _ Minutes <br /> October 26, 1978 <br /> Page 4 <br /> 2. 10 foot high doors, a requirement to permit use by applicant' s ve- <br /> 4L can be provided in a building with a maximum 12 foot <br /> height. (height to be determined as per 10.01 (7) - Dane County <br /> Zoning Ordinance) . <br /> CONCLUSION: <br /> a. Unnecessary hardship not proven, motion carried. <br /> #721. Motion by Purcell second by Voges to grant a variance of 16 feet <br /> from required rear yard. <br /> FINDING OF FACT: <br /> 1. Residence was constructed when required rear yard was 35 feet. <br /> Zoning ordinance was amended and 50 foot rear yard was required <br /> causing residence to be non-conforming. <br /> 2. Other residences in area have rear porches that were constructed <br /> prior to ordinance change or by variances granted after the <br /> change. <br /> 3. Well, septic and lower level gradage and drive prevent addition <br /> to other sides of residence. <br /> 4. Letter of no objection received from property owner to the rear. <br /> CONCLUSION: <br /> a. Proven case of unnecessary hardship. <br /> b. Variance is necessary to provide right enjoyed by others. <br /> c. Variance is not contrary to rights of others or to the public <br /> interest. _ <br /> Motion carried. <br /> #722. Motion by Voges second by Purcell to grant a 7 foot 8 inch variance <br /> from required setback from centerline of Coyier Street and to deny variance <br /> from required rear yard. <br /> FINDING OF FACT: <br /> 1. Coyier Street is a Class C road- equiring a 63 foot setback from <br /> center of road. 85 - 90% of all buildings on the street are <br /> non-conforming as to setback. <br /> 2. Proposed addition will be in line with existing building and will <br /> not cause a traffic hazard. <br /> 3. A reason for the 10 foot minimum rear yard is to provide access <br /> in case fire or emergency. <br /> 4. Proposed addition can be built without a variance but with some <br /> inconvenience to applicant as to truck access. <br /> CONCLUSION: <br /> Setback variance - a. Proven case of unnecessary hardship. b. <br /> Variance is necessary to provide right enjoyed by others. c. <br /> Variance is not contrary to rights of others or to the public in- <br /> terest. <br /> Rear yard variance - a. Convenience hardship. b. Unnecessary <br /> hardship not proven, truck access can be designed into new addi- <br /> tion. c. Others have maintained required rear yard. Motion <br /> carried. <br /> #723. Motion by Purcell second by Schwahn to grant a variance of 1 1/2 <br /> feet from reuqired setback from centerline of CTH "CV" (Lake Road) for <br /> Ls) bay window and to deny variance request for stoop. <br />
