BOARD OF ADJUSTMENT - Minutes <br /> October 26, 1978 <br /> Page 6 <br /> 1. A 13 foot wide attached garage could be built and there is ample <br /> area on the lot in which to build a garage without requiring a <br /> variance. <br /> 2. Property value enhancement by reason of an attached 2-car garage <br /> does not constitute an unnecessary hardship. <br /> CONCLUSION: <br /> Unnecessary hardship not proven. Motion carried. <br /> #728. Motion by Purcell second by Voges to deny. <br /> 1. There is ample area on the lot in which to build a residence <br /> designed for the lot. <br /> 2. R-2 Zoning is available which would require only a 35 foot rear <br /> yard, application for said R-2 has been submitted. <br /> CONCLUSION: <br /> ", a. Unnecessary hardship not proven. <br /> b. Alternate recourse is available. Motion carried. <br /> #729. Motion by Voges second by Schwahn to grant a variance of 8 feet <br /> from required setback from Furey Avenue property line. <br /> FINDING OF FACT: <br /> 1. Residence is on shallow (40 foot depth) lot and was constructed <br /> before pertinent setback regulations were in effect. <br /> 2. A variance would be required for any garage, attached or unattached, <br /> and facing Fury Avenue. <br /> 3. Garage will be located farther from street than the residence. <br /> CONCLUSION: <br /> Cr a. Proven case of unnecessary hardship. <br /> b. Variance is necessary to provide right enjoyed by others. <br /> c. Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried. <br /> #730. Motion by Schwahn second by Purcell to deny. <br /> FINDING OF FACT: <br /> 1. There is ample area on the lot in which to build without requiring <br /> a variance. <br /> 2. Desire for specific design does not constitute unnecessary hard- <br /> ship. The residence must be designed to fit the lot and not vice- <br /> versa. <br /> 3. No new evidence was introduced over and above previous appeal. <br /> CONCLUSION: <br /> a. Unnecessary hardship not proven. <br /> Staff report appeal #652 Kolberq - Lot #19 Belmar. Property appraisal <br /> has been completed and submitted to the Dane County Parks Commission. <br /> George Hibner has been directed to forward a copy of the appraisal to <br /> Department of Natural Resources for federal fund share approval.
