BOARD OF ADJUSTMENT - Minutes <br /> December 28, 1978 <br /> Page 2 <br /> (1110 #744. Motion by Krushchke second by Purcell to grant a variance as <br /> follows: <br /> Proposed Lot #1: 57.64 feet from required 100 foot lot width - <br /> 8,867.73 square feet from required 15,000 square <br /> foot area. <br /> Proposed Lot #2: 17.50 feet from required 100 foot lot width; 2,988.4 <br /> square foot from required 15,000 square foot area. <br /> FINDING OF FACT: <br /> 1. Proposed division will create 2 new lots from 4 existing lots. <br /> Each proposed lot will be larger than any one of the existing <br /> lots. <br /> 2. Each of the proposed lots is larger than most of the existing <br /> lots within the plat - many of which are utilized for resi- <br /> dential purposes. <br /> 3. Strict enforcement of shoreland provisions will not provide <br /> the intended protection of the area because the harm has al- <br /> ready been done. <br /> CONCLUSION: <br /> a. Proven case of unnecessary hardship. <br /> b. Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. <br /> c. Variance is necessary to provide right enjoyed by others. <br /> d. Variance is not contrary to rights of others or to the pub- <br /> lic interest. <br /> Motion carried. <br /> #740. Held in abeyance from November 30, 1978. IN FAVOR: Wm. Pfieffer <br /> Tim Fenner. Motion by Schwahn second by Voges to hold in abeyance <br /> pending submittal of specific contour and berm location plans and re- <br /> view by S.C.S.
