MINUTES OF THE DANE COUNTY BOARD OF ADJUSTMENT <br /> MEETING OF DECEMBER 16, 1977 <br /> CP' . <br /> PRESENT: Erickson, Dahlk, Voges <br /> Also present: Enger, Fleck. <br /> The meeting was called to order by Chairman Erickson at 7:30 P.M. in <br /> Room #226 to hold a public hearing as published by class II notice. <br /> Motion by Voges, second by Dahlk to approve minutes of November 18 <br /> and December 13, 1977. Motion carried. <br /> The notice was read and the public hearing was opened. <br /> #623. IN FAVOR: Dick Lee; ABC Builders OPPOSED: None TOWN BOARD: <br /> letter in favor. DANE COUNTY HIGHWAY: Opposed. <br /> #624. IN FAVOR: Leonard Judd OPPOSED: None TOWN BOARD: Chairman <br /> R. Baliweg, in favor. <br /> #625. IN FAVOR: Wm. Rutenburg; Mariner's Inn. OPPOSED: None <br /> TOWN BOARD: Jim Tierney and Robert Shepard, Supervisors - in favor. <br /> #626. IN FAVOR: Peder Sveum OPPOSED: None TOWN BOARD: Resolu- <br /> tion in favor. <br /> Cv #627. IN FAVOR: Sidney Grinde OPPOSED: None TOWN BOARD: letter <br /> in favor. <br /> #628. IN FAVOR: Robert Kay representing William McKee. OPPOSED: <br /> None Town Planning Commission; letter in favor. <br /> The public hearing was closed. <br /> #623. Motion by Dahlk second by Voges to hold in abeyance, no longer <br /> than 10 days. Motion carried. <br /> #624. Motion by Voges second by Dahlk to grant a variance of 7 feet <br /> from the required setback from centerline of Breunig Road as per find- <br /> ing of fact: <br /> 1. Location, the garage at the required setback would cause a very <br /> steep and impossible access from the driveway unless an excessive <br /> amount of fill were placed under the proposed building to bring it <br /> up to a reasonable level with the driveway. <br /> conclusion: <br /> a. Proven case of unnecessary hardship. <br /> b. Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. <br /> c. Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried. <br /> 1LV <br />
