Board of Adjustment - Minutes <br /> June 17, 1977 <br /> Pg. 3 <br /> A. Proven case of unnecessary hardship. <br /> Cif B. Variance is not contrary to rights of others or to the public <br /> interest. <br /> C. Hardship is caused by the ordinance and is not self-imposed. <br /> Motion carried. <br /> #576. Motion by Dahlk second by Voges to grant a special exception <br /> permit as applied for. <br /> 1. A very minimal area of fill is within the flood plain. <br /> 2. Original filling was done by the Department of Natural Resources <br /> when they dredged Token Creek Pond. Purpose of this filling is <br /> just to level off what the Department of Natural Resources had done. <br /> Motion carried. <br /> #540. Request from Windsor Skelly Truck Stop for reconsideration of <br /> their appeal as per site plan submitted. Motion by Dahlk second by <br /> Voges to grant a variance of 29 feet from required setback from <br /> centerline of Hoffman House Lane as per finding of fact. <br /> 1. Location was chosen to be out of truck traffic pattern. <br /> 2. Parking area is filled several times a day especially overnight <br /> and semi-truck maneuvering is very tight. <br /> 3. Hardship caused by having to provide road setbacks all around <br /> perimeter of the property. <br /> 4. Location in SW 1/4 corner of property is not feasible at this <br /> 1 Cr time because it necessitates removal of guard-rail, crushed rock <br /> fill, etc. <br /> CONCLUSION: <br /> A. Proven case of unnecessary hardship. <br /> B.
