4. That on February 22, 1974, the appellant, Melvin D. Cohen, was notified to <br /> comply with the above ordinance no later than March 31, 1974. <br /> S. That the appellant, Melvin D. Cohen, is engaged in the business of the retail <br /> sales of groceries and related items, which activity is not engaged in on the premises <br /> in question. <br /> 6. That the appellant, Melvin D. Cohen, Is adsq engaged in the business of the <br /> shipping and distribution of produce and related food items by truck to various retail <br /> outlets throughout Wisconsin, many of which are not owned by appellants. • <br /> 7: That the produce and other items so shipped are not grown upon the premises <br /> in question. <br /> • <br /> 8. That the truck tractors and semitrailers used in the course of Mr. Cohen's <br /> produce shipping and distribution business are often parked and/or stored upon the <br /> premises, and that such parking and/or storage is not done within storage facilities <br /> or docks, but that parking and/or storage is done in an open area on the premises <br /> in question. <br /> 9 . That, at all times material to this appeal, the Dane County Zoning Ordinances <br /> contained the following provision: <br /> "RESTRICTIONS UPON LANDS, BUILDINGS AND STRUCTURES. <br /> Except as otherwise herein provided: <br /> Use: No building or structure shall hereinafter be erected, and <br /> no existing building or structure shall be moved, altered, added <br /> to or enlarged, nor shall any land, building or structure or premises <br /> be used, designed or intended to be used for any purpose, or in any <br /> manner other than a use designated in this ordinance as permitted in <br /> the district in which land, building or structure is located." <br /> CONCLUSIONS OF LAW <br /> 1. That the parking and/or storage in an open area of truck tractor and semi- <br /> trailers which are used in a produce shipping and distribution business is not now, nor <br /> 4., has it ever been at any time material to this appeal, a permitted use in an A-1 <br /> Agricultural District, and that the appellants have therefore failed to comply with, <br /> the provisions of Section 10. 12 of the Dane County Zoning Ordinances. <br /> -2- <br />
