The applicant shall submit an engineering plan which will provide for <br /> adequate control of surface water run-off. The plan shall be submitte ; <br /> to the Dane County Board of Adjustment and the Westport Town Board, <br /> for review and approval, no later than August 17, 1984. <br /> 2. Approval of the plan shall be subject to: <br /> a) . Adequate erosion and siltation control. <br /> b) . Documentation that the project will not result in any adverse effe is <br /> to adjacent properties due to the diversion of surface water run- <br /> off. <br /> 3. The plan shall be implemented and work on the project commenced within <br /> 30 days of the approval of said plan. <br /> 4. The project shall be completed within 60 days of the approval of the <br /> plan. <br /> FINDING OF FACT: <br /> 1) . The property prior to filling had a substantial gulley caused by <br /> surface water erosion. Engineering reports indicated the 10 year <br /> storm run-off at 40 cubic feet per second. <br /> 2) . The property was filled to a depth varying from l foot at the road <br /> side to 5 .feet, more or less, at the lake side. A substantial <br /> amount of fill was placed. No permit was obtained to place the <br /> fill. <br /> 3) . The filling changed the surface water run-off pattern partially <br /> diverting it through an 8 inch culvert along the left property <br /> line with the balance finding its way to the adjacent property <br /> boardering the right property line. A shallow grassed swale <br /> was provided for the water run-off along the right property line. <br />
