Motion by Harvey, second by Purcell to grant a variance of 25 feet <br /> from required setback from C.T.H. "V" subject to the condition: <br /> The porch shall be removed at the owners expense if future road improvement <br /> requires additional right-of-way. <br /> FINDING OF FACT: <br /> 1) . Existing residence is nonconforming as to setback. <br /> 2) . Variance is necessary to replace deteriorated porch. <br /> CONCLUSION: <br /> a) . Proven case of unnecessary hardship. <br /> b) . Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> c) . Hardship is caused by the ordinance nad is not self-imposed. <br /> Motion carried. <br /> #1170. Motion by Kruschke, second by Purcell to deny. <br /> FINDING OF FACT: <br /> 1) . Lot, as exists, can be utilized as a building site. <br /> 2) . Proposed delineation will further reduce lot size of Lot #1. <br /> 3) . Main reason as expressed by applicant, was to permit lot line to be <br /> perpendicular to Balden Street. <br /> CONCLUSION: <br /> 1) . No hardship proven; aesthetics of lot line delineation cannot be con- <br /> ' <br /> sidered a hardship. <br /> 2) . Further size reduction of a non-conforming lot is not in the public <br /> interest. <br /> Motion carried. <br /> #1171. Motion by Purcell, second by Kruschke to grant a variance of 38 feet <br /> from required setback from S.T.H. 19 subject to the condition that: <br /> The stairway addition shall be removed at the owners expense if future road <br /> improvement requires additional right-of-way. <br /> FINDING OF FACT: <br /> 1) . Existing residence is non-conforming as to setback. <br /> 2) . Stairway is required by state law, migrant worker housing, to provide <br /> second exit for upstairs. <br /> 3) . Addition does not cause further encroachment towards the highway. <br /> CONCLUSION: <br /> a) . Proven case of unnecessary hardship. <br /> b) . Hardship is caused by the ordinance and is not self-imposed. <br /> Motion carried. <br /> #1172 . Motion by Harvey, second by Kruschke to grant a variance of 5 feet <br /> from required setback from Grove Road. <br /> FINDING OF FACT: <br /> 1) . Existing residence is non-conforming as to setback. <br /> 2) . Alteration/addition is interior remodeling and new basement, no further <br /> encroachment towards road. <br />
