BOARD OF ADJUSTMENT <br /> Minutes - July 28, 1983 <br /> Page 4 <br /> #1165. Motion by Harvey, seconded by Purcell to grant a variance of 660 square <br /> feet from maximum permitted square foot area for an accessory building; a 1 foo, <br /> (Or <br /> 4 inch variance from required side yard; a 1 foot variance from required rear <br /> yard and a variance of 10% from maximum permitted area coverage. <br /> FINDING OF FACT: <br /> 1) . Steep slope of lakeshore lots restricted construction of accessory buil ing. ' <br /> and- therefore the lot in question and two other similar lots were pro- <br /> vided, years ago, in a separate location to offset the problem. <br /> 2) . The- lot is very small in size and cannot be utilized for a realistic <br /> - accessory building use without variances. <br /> 3) . Land around the three lots has been purchased for a state park and open <br /> - space is more than adequate. <br /> CONCLUSION: <br /> 1. Proven case of unnecessary hardship. <br /> 2. Variance is not contrary to rights of others or to the public inter- <br /> - est. <br /> Motion carried. <br /> #1166. Motion by Kruschke, seconded by Harvey to hold in abeyance pending <br /> state variance regarding proximity to septic system. Motion carried. <br /> #1167. Motion by Harvey, seconded by Purcell to grant a variance of 29 feet <br /> from the required setback from Moe Road. <br /> FINDING OF FACT: • <br /> 1) . Existing residence is non-conforming as to setback from road. <br /> 2) . Proposed addition/alteration will not encroach farther into setback are. . <br /> • 3) . Hardship is caused by the ordinance and is not self-imposed. <br /> Motion carried. <br /> (1111, #1168. Motion by Harvey, seconded by Kruschke to hold in abeyance pending re- <br /> view of alternatives; motion carried. <br /> #1156. Motion by Kruschke, seconded by Purcell to deny. <br /> FINDING OF FACT: <br /> 1) Garage was constructed without permits. <br /> 2) . Waterline to neighbor, purported to prevent the complying location of <br /> the garage, is 17 feet behind the garage. Garage could have been located <br /> correctly in spite of the waterline. <br /> 3) . There are not topographical or other reasons which would have prevented <br /> -the garage from being located in compliance. <br /> CONCLUSION: <br /> 1. Hardship was self-imposed. <br /> 2. Unnecessary hardship was not proven. <br /> Motion carried. <br /> #1126, Motion by Kruschke, seconded by Harvey to amend. Minutes of January 7, <br /> 1983 to include "variance of 7% from maximum permitted lot coverage granted". <br /> Motion carried. <br /> Motion by Harvey, seconded by Purcell, motion carried.
