BOARD OF ADJUSTMENT - Minutes <br /> May 26, 1983 <br /> Page 3 <br /> Town Board does not wish to have a vacant home, subject to vandalism, <br /> etc. , because the builder or owners cannot comply with ordinance re- <br /> quirements. <br /> CONCLUSION: <br /> In light of the small variance necessary, the public interest <br /> would not be served by a denial of the variance. <br /> Motion carried. <br /> #1152. Motion by Harvey, second by Purcell to grant a variance of 13 feet, <br /> more or less from the required setback between the Lancaster Chevolet Buildin• <br /> and the proposed Lancaster Drive; granted. <br /> CONDITION: • <br /> The East Towne Burke Plat shall provide a building setback line on both <br /> sides of Lancaster Drive. Said setback line shall be parallel to and 30 <br /> feet distance from the right-of-way of Lancaster Drive. Said line shall <br /> not pertain to the existing encroachment of the Lancaster Chevolet Buildin• . <br /> FINDING OF FACT: <br /> 1. Both the Lancaster Chevolet Building and the improved road are existin• . <br /> 2. Location of right-of-way to provide required setback would place pave- <br /> ment and curb off center and outside of the right-of-way causing pro- <br /> blems with road maintenance, installation of lighting and sewer, etc. <br /> 3. Lancaster Drive had been constructed to town specifications at the re- <br /> quest of the town. <br /> 4. The condition imposed will protect the public interest with regard to <br /> setback for future buildings. <br /> CONCLUSION: <br /> 1) . Proven case of unnecessary hardship. <br /> 2) . Variance preserves the zoning ordinance as much as possible withoug <br /> injustice to applicant. <br /> 3) . Hardship is caused by the Ordinance and is not self-imposed. <br /> Motion carried. _ <br /> #1027. Lester Oimoen, Blue Mounds. Request for extension of variance to <br /> allow time to obtain a zoning permit. Motion by Harvey, second by Purcell <br /> to grant the extension. Motion carried. <br /> Motion by Kruschke, second by Purcell to adjourn.
