The repair cost of <br /> $4,514.20, even by this method, does exceed 50% of the assessed value of <br /> the building. <br /> The building now has 522 square feet as per floor plan recently submitted <br /> by Attorney Grapsas. This indicated substantial alteration and increase <br /> of facility. <br /> #1102. Motion by Kruschke, second by Purcell to grant a variance of 8 feet <br /> 4 inches, more or less, from required right side yard. <br /> FINDING OF FACT: <br /> 1. Construction is to cover and weatherproof an existing basement stair- <br /> way. <br /> 2. CSM #1049 - Volume 4, Page 332 discloses that the building on the <br /> lot to the West has only a one foot side yard. <br /> 3. This building was constructed in 1974 when required side yard was <br /> 0 feet. Zoning Ordinance Amendment in 1978 changed the side yard <br /> to 10 feet. <br /> CONCLUSION: <br /> 1. Proven case of unnecessary hardship. <br /> 2. Hardship is caused by the ordinance and is not self-imposed. <br /> 3. Variance is necessary to provide right enjoyed by others. <br /> Motion carried. <br /> #1097. Motion by Harvey, second by Kruschke to grant a variance of 6 <br /> feet, more or less, from required setback from property line/road right- <br /> of-way. <br /> FINDING OF FACT: <br /> 1.
