BOARD, OF ADJUSTMENT - Minutes <br /> September 23, 1982 <br /> Page 6 <br /> located to the East and there would be 4 or 5 other property owners in- <br /> volved. He will annex to city if denied. Motion by Schwahn, second by <br /> Harvey to deny variances requested. <br /> FINDING OF FACT: <br /> 1. There are no topographical or other problems which would have prevented <br /> the residence from being located in compliance. <br /> 2. Zoning Department records disclose that the first inspection for veri- <br /> fication of building location was not requested. <br /> CONCLUSION: <br /> 1. Self imposed hardship. <br /> 2. Unnecessary hardship was not proven. <br /> Motion carried. <br /> #1095. Bullock Garages-Dunn; held in abeyance from August 26, 1982 at <br /> request of Town Board. Communication, in favor of variance, received <br /> from town. Motion by Harvey, second by Purcell to grant a variance of <br /> 6 feet from required side yard. <br /> FINDING OF FACT: <br /> 1. 4 foot permitted side yard as per Section 10.16 (4) (g) and 10.16 (6) <br /> (a) 1. cannot be utilized because of required setback from highway and <br /> location of residence. <br /> 2. . Other buildings in the area, including residences, are as close or <br /> closer to side property lines. <br /> CONCLUSION: <br /> (11, 1. Proven case of unnecessary hardship. <br /> 2. Variance is necessary to provide right enjoyed by others. <br /> 3. Hardship is caused by the ordinance and is not self-imposed. <br /> Motion carried. <br /> #1093. Chellevold-Dunn; denied August 26, 1982 because of non-appearance at <br /> public hearing. Mr. Chellevold has submitted a request to allow re-applica- <br /> tion within one year of denial. Motion by Kruschke, second, by Schwahn to <br /> grant request. Motion carried. <br /> #1094. Hannigan-Dunn; Zoning inspection disclosed that existing building <br /> setback from water is 15 feet rather than the 17 feet as submitted by <br /> applicant and therefore variance granted is not adequate. <br /> Motion by Purcell, second by Schwahn to amend variance from 33 to 35 feet. <br /> Finding of fact and conclusion remain as stated on August 26, 1982. <br /> Motion carried. <br /> Motion by Schwahn, second by Harvey to adjourn.
