Benja- <br /> min, secretary, Benjamin Plumbing OPPOSED: None COMMUNICATION: <br /> None <br /> #1074. Appeal by Jerome Nonn for a variance from required setback from <br /> road as provided by Section 10. 17 (2) to permit addition to a barn at <br /> 7915 C.T.H. K, SW 1/4 SW 1/4 - Section 19, Town of Springfield. <br /> IN FAVOR: J. Nonn OPPOSED: None COMMUNICATION: Letter, Dane Coun <br /> Highway. No objection, with condition. <br /> The public was closed. <br /> #1061. Motion by Harvey, second by Purcell to grant a variance of 51 <br /> feet from the required setback from normal high waterline: <br /> FINDING OF FACT: <br /> 1) . Mr. Leis testified that the proposed addition is an un-enclosed <br /> deck to provide a fire exit for an. existing residence which is <br /> non-conforming as to setback from normal high waterline. <br /> 2) . Mr. Leis testified that the residence to the West was closer <br /> to the river than he would be. <br /> 3) . No addition to Mr. Leis residence could be permitted without a <br /> variance. <br /> (00 CONCLUSION: <br /> 1) . Proven case of unnecessary hardship. <br /> 2) . Variance is necessary to provide right enjoyed by others. <br /> 3) . Hardship is caused by the ordinance and is not self-imposed. <br /> Motion carried. <br /> #1062. Motion by Kruschke, second by Harvey to grant a variance of 6 <br /> feet from the required setback from Kasper Road with condition that <br /> the bin shall be removed at the owners expense if future road improve- <br /> ment requires additional right-of-way. <br /> FINDING OF FACT: <br /> 1) . Mr. Tiedt testified that proposed location is necessary for <br /> auger line-up with existing bin and dryer; turns or bends <br /> cause continual problems. <br /> 2) . Road is straight and bin will not create a traffic hazzard. <br /> 3) . Town Board was in favor. <br /> CONCLUSION: <br /> 1) . Proven case of unnecessary hardship. <br /> 2) . Variance is notcontrary to rights of others or to the public <br /> interest. <br /> Motion carried. <br /> #1063. Motion by Schwahn, second by Kruschke. <br /> 1) . Permit granted as per plans submitted. <br /> 2) . The filled and/or graded and disturbed areas shall be sodded <br /> 4.0 or seeded with fast growing grasses and mulched to prevent silt:- <br /> tion or erosion. <br />
