BOARD OF ADJUSTMENT - Minutes <br /> November 18, 1982 <br /> Page 3 <br /> 4 <br /> CONCLUSION: <br /> a) . Variance will not permit a use which has not already been esta- <br /> blished on the property. <br /> b) . Hardship is caused by the ordinance and is not self-imposed. <br /> c) . Proven case of unnecessary hardship. <br /> Motion carried. <br /> #1113. Motion by Purcell, second by Kruschke to grant the Special Excep- <br /> tion Permit as proposed with the following conditions: <br /> 1) . The filled and/or graded and disturbed areas shall be sodded or seeded <br /> with fast growing grasses and mulched to prevent siltation or erosion. <br /> 2) . The applicant shall request inspection by the Dane County Zoning Departs .� <br /> ment upon completion of the project. <br /> FINDING OF FACT: <br /> 1) . Intent and purpose of the project is to improve Badfish Creek and <br /> related maintenance. <br /> 2) . Project is designed with rip-rap, seeding, etc. which will assure <br /> control of erosion or siltation. <br /> CONCLUSION: <br /> a) . The project as planned, will not result in substantial detriment <br /> to navigable waters by erosion, sedimentation, impairment of fish <br /> or aquatic life, or safe and healthful conditions. <br /> Motion carried. <br /> #1114. Motion by Harvey, second by Schwahn to grant the Special Exception <br /> Permit with the following conditions: <br /> 1) . Spoils stockpiled for dewatering shall be located or mulched so as to <br /> prevent siltation or erosion into lake. <br /> 2) . All spoils shall be spread and leveled. <br /> 3) . The filled and/or graded and disturbed areas shall be sodded or seeded <br /> with fast growing grasses and mulched to prevent siltation or erosion. <br /> 4) . The applicant shall request inspection by the Dane County Zoning <br /> Department upon completion of the project. <br /> CONCLUSION: <br /> a) . The project as planned, with specified conditions; will not re- <br /> sult in substantial detriment to navigable waters by erosion, <br /> ` , sedimentation, impairment of fish or aquatic life, or safe and <br /> healthful conditions. <br /> Motion carried. <br /> #1115. Motion by Purcell, second by Kruschke to grant a variance of 3 feet, <br /> more or less, from the required setback from normal high water line. <br /> Granted. <br /> FINDING OF FACT: <br /> 1) . Existing residence is 40-50 years old and is non-conforming as to <br /> setback from normal high water line. <br /> 2) . Second story addition does not encroach further into shoreland set- <br /> back than the existing residence. <br />
