10 )i\Pl) ))I' Al IH:,'lMI.tJ'I' Mi))ul , <br /> October 22, I`)H I <br /> Page 4 <br /> The lower portion of the berm, at cross sections 2 and 3, is 1 to 1.5 <br /> feet less in width than specified , hut, the average depth (top to bottom) <br /> is greater than specified thereby providing a larger mass than specified. <br /> Reworking the berm at this time of year could cause considerable erosion <br /> and siltation because new seed would not germinate. Compliance with <br /> permit specification would not provide enough additional protection or <br /> control to warrant re-working of the project. <br /> The statement by the contractor verified compaction and the stability <br /> of the berm. <br /> The system will provide a filtered, low velocity, run-off into the marsh, <br /> minimizing siltation and erosion. Ponding may occur on the property <br /> inside of the berm with the event of abnormally high water level in <br /> the marsh, but, this water would again filter out as the marsh level <br /> subsided. The ponding would occur even if the system had not been con- <br /> structed. Therefore, safe and healthful conditions will not be sub- <br /> stantially changed. <br /> CONCLUSION: <br /> 1. Project as constructed meets the intent of the soil erosion plan <br /> and will not result in substantial detriment to navigable waters by <br /> erosion, sedimentation, impairment of fish or aquatic life or safe <br /> and healthful conditions. <br /> 2.
