Building was located in error by D. Zimmerman on the assumption <br /> that lot stakes provided were correct. <br /> 2. There is no topographical or other reason that would have pre- <br /> vented locating the building in compliance. <br /> CONCLI 1 X11 ON: <br /> 1 . Unnecessary hardship was not proven. <br /> Motion carried. <br /> #1011 . Motion by Schwahn, second by Harvey to grant the Special Excep- <br /> tion Permit, plan as proposed , with the following conditions: <br /> 1. All spoils shall be spread and leveled. <br /> 2. Banks of new ditches and existing ditch banks which have been <br /> disturbed by the dredging shall be seeded with fast growing <br /> grasses. <br /> 3. The applicant shall request inspection by the Dane County Zoning <br /> Department upon completion of the project. <br /> FINDING OF FACT: <br /> Project has legitimate purpose; drainage of cropland. <br /> CONCLUSION: <br /> 1. Digging of new ditches is necessary to provide provide proper <br /> drainage of existing field. <br /> 2. The project as planned, with specified conditions; will not re- <br /> sult in substantial detriment to navigable waters by erosion, <br /> sedimentation, impairment of fish or aquatic life, or safe and <br /> healthful conditions. <br /> Motion carried. <br /> #1012. Motion by Kruschke, second by Schwahn to grant a variance of <br /> 18 feet from the required setback from C.T.H. "8" . <br /> FINDING OF FACT: <br /> I. Proposed location was determined by location of existing double <br /> window which will be converted to french doors. Location farther <br /> back from road would place porch on bedroom wall. <br /> 2. Porch will be located farther back from road than the existing <br /> residence and will not cause any additional traffic hazard. <br /> CONCLUSION: <br /> 1. Proven case of unnecessary hardship. <br /> 2. Variance is not contrary to rights of others or to the public in- <br /> terest. <br /> Motion carried. <br /> #1013. Motion by Schwahn, second by Kruschke to grant a variance of <br /> 7 feet from the required setback from front property line. <br /> FINDING OF FACT: <br /> 1. Adjacent buildings are as close, or closer to front property line <br /> and road. <br /> 2 . Addition is to improve entry; a covered entry could not be con- <br /> structed without-. a variance. <br />
