Holtshopple OPPOSED: None COMMUNICATION: None <br /> #983. Appeal by Herman Hoffman for a variance from required setback <br /> from road as provided by Section 10. 17 (3) to permit construction of a <br /> loafing shed at 6379 Matz Road, NW 1/4 NW 1/4 - Section 1, Town of Berry. <br /> IN FAVOR: H. Hoffman OPPOSED: None TOWN BOARD: H. Hoffman, Chairman, <br /> in favor 2-0. COMMUNICATION: None <br /> #975. Recalled - no appearance. <br /> The public hearing was closed. <br /> #970. Motion by Kruschke, second by Schwahn to grant the Special Exception <br /> Permit as proposed. <br /> FINDING OF FACT: <br /> 1. Flood heights will be increased less than 0. 1 of a foot. <br /> 2. Disturbed areas will be seeded to prevent erosion. <br /> 3. Purpose of project is in the public interest. <br /> CONCLUSION: <br /> The project as planned, will not result insubstantial detriment to <br /> navigable waters by erosion, sedimentation, impairment of fish or <br /> aquatic life, or safe and healthful conditions. <br /> Motion carried. <br /> #971. Motion by Schwahn, second by Purcell to grant a variance of 5 <br /> feet from required left side yard. <br /> FINDING OF FACT: <br /> 1. Ramp addition is necessary to comply with State codes. <br /> 2. Ramp is not possible in any other location. <br /> CONCLUSION: <br /> Proven case of unnecessary hardship. Variance is not contrary to <br /> rights of others or to the public interest. <br /> Motion carried. <br /> #972. Motion by Voges, second by Kruschke to grant a variance of 3 feet <br /> • from required right side yard, granted with the rendition that the deck <br /> may not he enclo!;eei. <br /> FUNDING OP PACT: <br /> 1 .
