BOARD OF ADJUSTMENT - Minutes <br /> October 23, 1980 <br /> Page 4 <br /> 14,\ #945. Motion by Kruschke, second by Schwahn to grant a variance of 30 <br /> feet from required setback from normal high waterline. <br /> FINDING OF FACT: <br /> 1. Neighbor on left and others in the area are as close or closer <br /> to the lake. <br /> CONCLUSION: <br /> a. Proven case of unnecessary hardship. <br /> b. Variance is necessary to provide right enjoyed by others. <br /> c. Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried. <br /> #946. Motion by Voges, second by Kruschke to grant a variance of 30 feet <br /> from required setback from C.T.H. AB. <br /> FINDING OF FACT: <br /> 1. Garage cannot be built elsewhere on lot. <br /> 2. Neighboring garages are as close or closer. <br /> 3. Dane County Highway has no objection and no other objections were <br /> presented. <br /> CONCLUSION: <br /> a. Proven case of unnecessary hardship. <br /> b. Variance is necessary to provide right enjoyed by others. <br /> c. Variance is not contrary to rights of others or to the public <br /> interest. <br /> (1110 Motion carried. <br /> #947. Motion by Schwahn, second by Voges to deny the requested side yard <br /> variance and grant the variance of 62 feet from the required setback from <br /> S.T.H. 92. The building shall be removed at the expense of the property <br /> owner in the event that additional right-of-way is required for highway <br /> improvement. <br /> FINDING OF FACT: <br /> 1. Most of the buildings along S.T.H. 92 in Mt. Vernon are non-confo ing <br /> as to setback from highway and the proposed garage will not be <br /> closer than many in the area. <br /> 2. Bank at front of property prevents garage from being located much <br /> farther back from road. <br /> 3. Required side yard can be provided as there are no obstructions to <br /> the side which would prevent required location of the building. <br /> CONCLUSION: <br /> a. Variance is necessary to provide right enjoyed by others. <br /> b. Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried. <br /> #914. Held in abeyance from September 25, 1980; London Cheese Cellar. <br /> Motion by Schwahn, second by Kruschke to reluctantly deny requested variance. <br /> Information from the State Highway Department discloses they will not per- <br /> mit the sign in question and therefore the variance would be useless. <br /> Motion carried. <br />
