Motion by Purcell, second by Voges to grant a variance of 10 <br /> feet from required lot width. <br /> FINDING OF FACT: <br /> 1. Shape of lot and critical location of septic system due to slope, <br /> etc. , limit the useable buildable area on the lot. <br /> 2. Zoning Ordinance has no provision, other than variance, to allow <br /> for consideration of #1 above. <br /> 3. Granting of variance will not change required side or rear yards, <br /> or setback. <br /> CONCLUSION: <br /> a. Proven case of unnecessary hardship. <br /> b. Variance is not contrary to rights of other or to the public <br /> interest. <br /> c. Hardship is caused by the ordinance and is not self-imposed. <br /> Motion carried. <br /> #912. Motion by Schwahn, second by Purcell to deny. Board of Adjustment <br /> has no authority to grant a Special Exception for such a use. <br /> Motion carried. <br /> #913. Motion by Voges, second by Kruschke to grant a variance of 8 feet <br /> from required setback from normal high waterline and 6.5 feet from re- <br /> quired left side yard. <br /> FINDING OF FACT: <br /> 1. Addition will be farther from water than the existing residence. <br /> 2. Existing residence is non-conforming as to side yard and setback <br /> from water and existed prior to shoreland and flood zone provisions <br /> of the Ordinance. <br /> 3. Flood zone area in right front of lot restricts building in that <br /> area. <br /> CONCLUSION: <br /> a. Proven case of unnecessary hardship. <br /> b. Variance is not contrary to rights of others or to the public <br /> interest. <br /> c. Hardship is caused by the ordinance and is not self-imposed. <br /> Motion carried. <br /> #914. Motion by Voges, second by Kruschke to hold in abeyance for 1 month <br /> to provide time to determine State Highway position. Motion carried. <br /> #915. Motion by Kruschke, second by Purcell to grant a variance of 9 feet <br /> from required setback from Webb Avenue. <br /> FINDING OF FACT: <br /> 1. Parcel is too shallow to allow garage to be set back the required <br /> distance. <br /> 2. Proposed garage will not be closer to the road than the residences <br /> to either side. <br /> 3. Similar variances in this area have been granted for others. <br /> CONCLUSION: <br /> a. Proven case of unnecessary hardship. <br /> b. Variance is necessary to provide right enjoyed by others. <br />
