Lot stakes were not located nor identified to verify required location. CONCLUSION: a. Location of buildings to comply with required setback, yards, etc. , is the responsibility of the builder and owner. b. Utilization of original site plan, without lot stake verification, to locate the addition to the main building and the accessory building was at the discretion of the owner. c. Hardship is not the fault of the ordinance but was caused by decisions of the property owner. d. Unnecessary hardship was not proven. Motion carried. 4876. Motion by Schwahn, second by Voges to grant the Special Exception Permit as proposed by the plan submitted and as per the conditions agree• upon at the April 29, 1980 meeting between Carl Stemrich; Ron Hayes, PE; Jim Mueller, Parks Department; Bill Fleck, Zoning. See letter of April 30, 1980 attached. And, more specifically: 1. Embankment, buffer strip and plantings shall be completed this year and shall be subject to final approval by the Parks Depart- ment. 2. In the event that the buffer strip fails to control the run-off of oil, gasoline or salt, other pollution control measures shall be implemented subject to Board of Adjustment approval. 3. Dumping of extraneous items or materials* shall be prohibited. (11110 Items or materials which are dumped shall be immediately cleaned up and removed from the property. FINDING OF FACT: 1. Plan is designed to prevent siltation, erosion and pollution from the truck stop which could adversely effect the marsh area, Token Creek, and fish or aquatic life. Motion carried. Motion by Kruschke, second by Schwahn to adjourn. Motion carried.
