BOARD OF ADJUSTMENT - Minutes <br /> February 28, 1980 <br /> Page 4 <br /> #871. Motion by Kruschke, second by Voges to grant a variance of 2 feet <br /> from maximum allowed height. <br /> FINDING OF FACT: <br /> 1. Accessory building is located on a 3+ acre parcel, will not <br /> obstruct view or open area of any other property owner. <br /> 2. Height restriction was inadvertantly missed when zoning permit <br /> was issued and construction of roof is substantially complete. <br /> CONCLUSION: <br /> a. Proven case of unnecesary hardship. <br /> b. Variance preserves the Zoning Ordinance as much as possible <br /> without injustice to applicant. <br /> Motion carried. <br /> #608. Motion by Schwahn, second by Voges to hold in abeyance to provide <br /> time for inspection by the Board. Motion carried. <br /> #864. Motion by Kruschke, second by Schwahn to deny. <br /> FINDING OF FACT: <br /> 1. A variance to allow the residence to be closer to the left side <br /> line has already been granted. A variance for the other side <br /> also is bending the Ordinance too much. <br /> 2. The architect has stated that re-design of the entry and stoop <br /> is possible and a variance would not be required. <br /> CONCLUSION: <br /> a. Intent of the Ordinance would not be maintained with a <br /> variance for both sides. <br /> b. Re-design would alleviate necessity for variance. <br /> Motion carried. <br /> Motion by Voges, second by Schwahn to adjourn.
