Pages:9 <br /> WITNESSETH: <br /> THIS SPACE RESERVED FOR RECORDING DATA <br /> WHEREAS, Grantor is the owner of certain real property NAb¢ANU RETt 7tI1N ADDRESS <br /> in the Town of Springdale, Dane County, Wisconsin, as described Brad and Heaether Bilse <br /> in the attached Exhibit A(the"Grantor Parcel"); 2560 County Road H <br /> ' Bameveld,WI 53507 <br /> WHEREAS, Grantee is the owner of certain real property <br /> located adjacent to the Grantor Parcel in the Town of Springdale, <br /> Dane County, Wisconsin, as described in the attached Exhibit B 054/0607-053-9595-0 <br /> (the"Grantee Parcel"); 054/0607-053-9570-0 <br /> TAX PARCEL IDENTIFICATION NUMBER(S) <br /> WHEREAS,Exhibit D depicts a septic field which runs over,on,about and across <br /> portions of the Grantor Parcel for the benefit of the Grantee Parcel. <br /> WHEREAS, Grantor and Grantee desire to set forth certain agreements and covenants <br /> regarding the creation, establishment and maintenance of the septic easement for the benefit of <br /> the Grantee Parcel permitting access over the Grantor Parcel,as set forth in more detail herein. <br /> NOW, THEREFORE, for good and valuable consideration,the receipt and sufficiency of <br /> which are hereby acknowledged,the undersigned parties agree as follows: <br /> 1. Grant of Easement. The Grantor hereby grants to Grantee for itself,its successors <br /> and assigns, a permanent non-exclusive easement over, under and across a particular area of the <br /> Grantor Parcel as described in Exhibit C attached hereto ("Easement Area"), for the following <br /> purposes: to build, construct, operate, inspect, maintain, repair, reconstruct and enlarge any and <br /> all presently existing and hereinafter constructed septic system drainage field and related <br /> facilities for a conventional septic system, with the right of entry in, across, beneath, and above <br /> the Easement Area, provided, however, that Grantee's exercise of its rights granted under this <br /> paragraph shall not unreasonably interfere with the use of, ingress or egress to or from, or <br /> activities on the Grantor Parcel. <br /> 2. No Interference. Grantor, nor its respective guests or invitees, shall not do <br /> anything to interfere with Grantee's use of the Easement Area as described herein. No barriers, <br /> fences, dividers or other obstructions to the Easement Area shall be constructed such that <br /> Grantee's access to the septic system is unreasonably hindered. <br /> 3. Maintenance. Grantee (or its successors in interest and assigns) shall be <br /> responsible, at its sole cost and expense, for all maintenance, repairs and/or replacements <br /> required or advisable within the Easement Area with respect to the septic system, including but <br /> 1 <br />
