B.O.A./Minutes/8/25/88
Page 6
CONCLUSION:
1) . Variance is necessary to provide right enjoyed by others.
2). Variance is not contrary to rights of others or to the public interest.
Carried - 4-0.
#1748. Harvey/Quackenbush to grant with condition variance of 36 feet more or
less feet from maximum height of structures surrounding the Dane County
Regional Airport to permit erection of electric transmission lines.
CONDITIONS:
1). Variance granted subject to F.A.A. approval and permit.
FINDING OF FACT:
1) . Public Service Commission has determined location of route and location
of towers.
2). Variance from height due to code clearance above the road.
3) . Only one (1) tower needs the maximum 36 more or less foot height variance.
4). County Airport has no objection.
CONCLUSION:
1) . Hardship is caused by the ordinance and is not self-imposed.
2) . Variance is not contrary to rights of others or to the public interest.
Carried - 4-0.
#1749. Quackenbush/Harvey to grant variance of 18.1 more or less feet from
required setback from normal high watermark to permit deck addition to
residence as constructed.
FINDING OF FACT:
1) . Deck has been in existance for 9 more or less years - built without
permit.
2) . Deck has been "bermed" around and is not a visionary impediment.
3) . Other properties have received similar variances.
CONCLUSION:
1) . Variance is not contrary to rights of others or to the public interest.
2) . Hardship is caused by the ordinance and is not self-imposed.
Carried - 4-0.
#1750. Harvey/Jones to hold in abeyance until September 22nd Hearing to allow
applicants to submit engineering plans for improvement by a certified engineer.
Carried - 4-0.
#1751. Harvey/Jones to hold in abeyance until September 22nd Hearing upon
request of applicant and adjoining property, enabling them to resolve
neighbors objection.
Carried - 4-0.
#1752. Quackenbush/Jones to deny requested variance to allow existing storage
building to remain on property without a primary residence.
FINDING OF FACT:
1) . Applicant had inquired of zoning prior to acquiring building and Learned
that building would not be permitted on property.
2) . No similar situations of accessory buildings without residence in the
L. area.
