Appeal by Peter + Nancy Christopher for a Special Exception Permit as <br /> provided by Section 11.05 (3) to permit filling, grading, etc. , within 300 <br /> feet of Lake Kegonsa at 3270 Brooklyn Drive on Lot #11, Camp Columbia - <br /> Section 25, Town of Dunn. <br /> IN FAVOR: P. Christopher, N. Christopher, letter - J + S Holtan OPPOSED: <br /> J. Robar, letter - Mrs. A. Dahlen COMMUNICATION: None. <br /> Public hearing was closed and Board rendered the following decision: <br /> #1651. Rouse - Madison. <br /> Kruschke/Miller to hold in abeyance until January public hearing to allow <br /> verification of perported annexation to City of Madison. Motion carried - 4-0. <br /> #1652. Crawford - Dunn. <br /> Jones/Kruschke to deny requested variance from road setback. <br /> FINDING OF FACT: <br /> 1) . Applicant submitted site plan upon permit application showing structure <br /> located 100 feet+ setback however actual field location is dramatically <br /> different. 2) . It appears that structure could have been located without or <br /> at least a minimal variance. 3) . Storm water run-off and ponding could be <br /> eliminated by filling, berming or creating a swale for water diversion. <br /> CONCLUSION: <br /> 1) . Unnecessary hardship was not proven. <br /> Motion carried - 4-0 . <br /> #1653. Reinders - Pleasant Springs. <br /> Kruschke/Miller to hold in abeyance, abeyance not to exceed 60 days, pending <br /> submittal of engineering data. Motion carried - 4-0. <br /> #1654. Mitchell - Dunn. <br /> Miller/Quackenbush to hold in abeyance, abeyance not to exceed 30 days, to <br /> allow applicant to seek alternative plans. Motion carried - 4-0. <br /> #1655. Pelligrino - Westport. <br /> Jones/Quackenbush to find that the conditions are met and grant permit for <br /> construction of retaining walls. <br /> FINDING OF FACT: <br /> 1) . New residential construction necessitates reconstruction of former <br /> retaining structures. 2) . Existing grade is maintained and new walls <br /> stabilize that grade. <br /> CONCLUSION: <br /> 1) . The project as planned, will not result in substantial detriment to <br /> navigable waters by erosion, sedimentation, impairment of fish or aquatic <br /> life, or safe and healthful conditions. <br /> #1656. Christopher - Dunn. <br /> Quackenbush/Kruschke to hold in abeyance, abeyance not to exceed 30 days, <br /> pending submittal of engineering data also directing applicant to take <br /> saw immediate measures to prevent further soil erosion.
