Possible relocation of addition would alleviate need for variance. <br /> 2) . No other similar variances in the area. <br /> CONCLUSION: <br /> 1). Unnecessary hardship was not proven. <br /> Motion carried. 3-0. <br /> #1397: Bozelka-Dunn. <br /> Kruschke/Schwahn to grant special exception permit to place fill within 300 <br /> feet of Lake Kegonsa to allow construction of residence garage. <br /> CONDITIONS: <br /> 1). All spoils shall be spread and leveled. <br /> 2) . The filled and/or graded and disturbed areas shall be sodded or seeded <br /> with fast growing grasses and mulched to prevent siltation or erosion. <br /> CONCLUSION: <br /> 1). The project as planned with specified conditions; will not result in <br /> substantial detriment to navigable waters by erosion, sedimentation, <br /> impairment of fish or aquatic life, or safe and healthful conditions. <br /> #1398: Delwich-Westport. <br /> Kruschke/Schwahn to grant a special exception permit to place fill and grade <br /> within 300 feet of Lake Mendota and Spring Creek. <br /> CONDITIONS: <br /> 1). Permit granted as per plans submitted. <br /> 2) . The applicant shall request inspection by the Dane County Zoning <br /> Department upon completion of the project. <br /> CONCLUSION: <br /> 1). The project as planned, with specified conditions; will not result in <br /> substantial detriment to navigable waters by erosion, sedimentation, <br /> impairment of fish or aquatic life, or safe and healthful conditions. <br /> 2) . The project as planned with specified conditions will preserve the <br /> natural shoreline. <br /> #1399: Grant-Dunn. <br /> Schwahn/Kruschke to grant variance of 21 more or less feet to normal high <br /> waterline to allow second story. <br /> FINDING OF FACT: <br /> 1). Addition will extend no closer to normal high waterline than existing <br /> residence. <br /> 2). An area of restrictive lots and nonconforming structures. <br /> CONCLUSION: <br /> 1). Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> 2). Hardship is caused by the ordinance and is not self-imposed. <br /> Motion carried. 3-0. <br />
