. r i b or at the time any land division is approved, which agreement shall include, at a minimum, provisions for erosion control, stormwater drainage, road improvements, including payment for any additional road improvement charges necessary because of either drainage or subsoil problems with the property, and payment of engineering and attorney review fees and charges incurred in connection with the land division, development, and rezoning of the property which have not already been paid or, for which reimbursement has not otherwise been provided, by the property owners or other third parties. C. A 90 day delayed effective date following adoption by the Dane County Board of Supervisors is hereby approved for the rezoning, and no rezoning will take place if the petition for land division by Certified Survey Map in substantial compliance with Exhibit B is not submitted within 90 days of the date of this resolution. D. This rezoning will be effective only if the owners of the property execute and record the restrictions found at Exhibit C attached hereto. The owners shall also refer to such restrictions on any Certified Survey Map which may be approved for this property. Section 3 . Nothing contained in the above shall act as an approval of any subsequent actions to be taken by the Town, including approval of any submitted Certified Survey Map, nor are any such statements to create any vested rights in the property. The above and foregoing resolution was duly adopted by the Town Board of Supervisors of the Town of Westport, Dane County, Wisconsin at a regular meeting held on December 20, 1993 .
