. r i b <br /> or at the time any land division is approved, which <br /> agreement shall include, at a minimum, provisions for <br /> erosion control, stormwater drainage, road <br /> improvements, including payment for any additional road <br /> improvement charges necessary because of either <br /> drainage or subsoil problems with the property, and <br /> payment of engineering and attorney review fees and <br /> charges incurred in connection with the land division, <br /> development, and rezoning of the property which have <br /> not already been paid or, for which reimbursement has <br /> not otherwise been provided, by the property owners or <br /> other third parties. <br /> C. A 90 day delayed effective date following adoption by <br /> the Dane County Board of Supervisors is hereby approved <br /> for the rezoning, and no rezoning will take place if <br /> the petition for land division by Certified Survey Map <br /> in substantial compliance with Exhibit B is not <br /> submitted within 90 days of the date of this <br /> resolution. <br /> D. This rezoning will be effective only if the owners of <br /> the property execute and record the restrictions found <br /> at Exhibit C attached hereto. The owners shall also <br /> refer to such restrictions on any Certified Survey Map <br /> which may be approved for this property. <br /> Section 3 . Nothing contained in the above shall act as an <br /> approval of any subsequent actions to be taken by the Town, <br /> including approval of any submitted Certified Survey Map, nor are <br /> any such statements to create any vested rights in the property. <br /> The above and foregoing resolution was duly adopted by the Town <br /> Board of Supervisors of the Town of Westport, Dane County, <br /> Wisconsin at a regular meeting held on December 20, 1993 .
