RESTRICTIONS AFFECTING <br /> PROPERTY OF CRAIG AND JANICE FAGA <br /> TOWN OF WESTPORT, DANE COUNTY, WISCONSIN <br /> This declaration is made on the day by Craig and Janice Faga and for their lawful of 1993 <br /> successors, assigns and grantees, heirs, <br /> as owners of the real estate odescribedsattExhibit (Ahheretoers�� <br /> "property") , (they <br /> located in the Town of Westport, County of Dane, <br /> State of Wisconsin. <br /> The undersigned owners, being the sole owners of the <br /> Property, for and in consideration of the mutual benefits ps <br /> to and from the owners and those who may hereafter purchaseaoring <br /> own the property and the other parties named below, hereby <br /> declare and provide that the property is subject to the followin g <br /> conditions, covenants and restrictions: <br /> A. Term Bindin O Successors. <br /> restrictions are to run with the elando and ashallnbe <br /> binding on all grantees, heirs, successors and assigns <br /> and other persons claiming under them until such time <br /> as these restrictions are amended, altered, modified or <br /> withdrawn pursuant to the terms of this document. <br /> B. Amend_, No amendment, alteration, modification or <br /> withdrawal of these covenants and restrictions will be <br /> allowed without approval, in writing, from the Town <br /> Board of the Town of Westport, the owners of lands <br /> resulting from any division of the property, and the <br /> owners of all lands located within 3000 feet of the <br /> property. <br /> C. Enforcement <br /> 1. To enforce conformity to these restrictions, the <br /> Town Government of the Town of Westport or <br /> successor, and/or the County Government of the <br /> County of Dane shall each have the right to <br /> proceed at law or equity to compel compliance with <br /> the terms hereof; and/or to prevent the violation <br /> or breach of any of them; and/or for monetary <br /> damages. The failure to promptly enforce any of <br /> the reservations and restrictions shall not bar <br /> their enforcement.
