PAGE 6, SB MTG MIN 4-29-93 Chair stated that, if we make a contract with BFI, the way it is written right now, they have annexed to City of Madison and the Degenhardt property is already gone, then taxes from the BFI Landfill and Degenhardt property will come to Burke for five (5) years. BFI says, "No Problem. " City of Madison says, "only if it is not a contested annexation", if we file contested papers on Monday, the City of Madison says, "they are not going to go along with the 5 years. " Chair read the Planning Commission's temporary proposal or conditions they tossed about on Wednesday evening (see copy of P.C. conditions) . Lengthy discussion. Motion to close Public Hearing was made by Jeff Heisig. Second by William Kurt. Motion carried. POSSIBLE ACTION ON REQUEST OF C.U.P. FOR 5067 REINER ROAD Discussion. William Kurt made a motion that, the Town of Burke does not oppose Dane County granting CUP Application No. 1066; provided however, the existing Agreement with the Applicants covering the CUP No. 788, be amended to cover the additional 60 acres described in Application No. 1066 and that the following provisions be added thereto: (See attached conditions, along with copy of Motion, that attorney faxed to us following day. ) Second by Jeff Heisig. Motion carried. POSSIBLE ACTION ON BFI AGREEMENT Long discussion. David Schmidt moved to approve draft #3 of Landfill Agreement, as amended by notations on that document, and subject to Chairman having the ability to negotiate such further language changes, as may be necessary, to clarify the intent of the parties. Second by Jeff Heisig. Motion carried. Both Jeff Heisig and Chairman Wiganowsky will meet with the attorney, at his office at 1 :30 on Monday. Debbie Stenson made an motion, In the event that BFI does not sign the amended and restated agreement by 2:00 P.M. on Monday May 3, the attorney will automatically file papers protesting the annexation. Second by William Kurt. Motion carried.
