PAGE 6, SB MTG MIN 4-29-93 <br /> Chair stated that, if we make a contract with BFI, the way <br /> it is written right now, they have annexed to City of <br /> Madison and the Degenhardt property is already gone, then <br /> taxes from the BFI Landfill and Degenhardt property will <br /> come to Burke for five (5) years. BFI says, "No Problem. " <br /> City of Madison says, "only if it is not a contested <br /> annexation", if we file contested papers on Monday, the City <br /> of Madison says, "they are not going to go along with the 5 <br /> years. " <br /> Chair read the Planning Commission's temporary proposal or <br /> conditions they tossed about on Wednesday evening (see copy <br /> of P.C. conditions) . Lengthy discussion. <br /> Motion to close Public Hearing was made by Jeff Heisig. <br /> Second by William Kurt. Motion carried. <br /> POSSIBLE ACTION ON REQUEST OF C.U.P. FOR 5067 REINER ROAD <br /> Discussion. <br /> William Kurt made a motion that, the Town of Burke does not <br /> oppose Dane County granting CUP Application No. 1066; <br /> provided however, the existing Agreement with the Applicants <br /> covering the CUP No. 788, be amended to cover the additional <br /> 60 acres described in Application No. 1066 and that the <br /> following provisions be added thereto: <br /> (See attached conditions, along with copy of Motion, that <br /> attorney faxed to us following day. ) <br /> Second by Jeff Heisig. Motion carried. <br /> POSSIBLE ACTION ON BFI AGREEMENT <br /> Long discussion. <br /> David Schmidt moved to approve draft #3 of Landfill <br /> Agreement, as amended by notations on that document, and <br /> subject to Chairman having the ability to negotiate such <br /> further language changes, as may be necessary, to clarify <br /> the intent of the parties. Second by Jeff Heisig. Motion <br /> carried. <br /> Both Jeff Heisig and Chairman Wiganowsky will meet with the <br /> attorney, at his office at 1 :30 on Monday. <br /> Debbie Stenson made an motion, In the event that BFI does <br /> not sign the amended and restated agreement by 2:00 P.M. on <br /> Monday May 3, the attorney will automatically file papers <br /> protesting the annexation. Second by William Kurt. Motion <br /> carried. <br />
