EXHIBIT A <br /> Conditions and Restrictions <br /> AREA: <br /> The conditional use permit area ("CUP 1066") shall be for the portion of the E1/2 of <br /> the SE1/4 of Section 26, T8N, R10E, Town of Burke, Dane County, Wisconsin, <br /> described as follows: <br /> Beginning at the southeast corner of Section 26; thence north 2,040 ft along the east <br /> line of Section 26,; thence west along a line parallel to the north line of the SE1/4 of <br /> Section 26, to the west line of the NE1/4 of the SE1/4; thence south along said west <br /> line to the south line of Section 26; thence east along said south line to the southeast <br /> corner of Section 26. <br /> LIMITATION TO CLAY REMOVAL ONLY: <br /> Only clay for use at the Mad-Prairie Landfill can be removed from the above <br /> described property and only in conformance with the conditions and restrictions set <br /> forth herein. No other minerals including gravel and rock can be extracted. <br /> OPERATION: <br /> Clay removal operations shall be limited to Monday through Friday, 7:00 a.m. - 5:00 <br /> p.m. Clay will be removed in accordance with the procedures set forth in the <br /> Feasibility Report to the BFI Landfill; a copy of the relevant pages are attached hereto <br /> and incorporated herein. No blasting shall be conducted. <br /> TRUCKING: <br /> It is required that all trucks hauling clay from the CUP area, when exiting north from <br /> the CUP area, shall use the truck route described as Reiner Road to Nelson Road. <br /> Trucking of clay shall not occur during the winter/spring road break up is determined <br /> by the Town of Burke. No truck hauling of fill to the CUP area shall be permitted. <br /> RECLAMATION: <br /> When the clay has been removed, or within twelve (12) months of the expiration or <br /> revocation of the Conditional Use Permit, whichever is the earlier, the Property will <br /> be reclaimed pursuant to NR504.05(10)(e) which references Section 208.3 of the <br /> Wisconsin Department of Transportation Standard Specifications for Road and Bridge <br /> Construction; copies of which are attached hereto and incorporated herein. The final <br /> grades are set forth at Attachment A and will be achieved with on-site materials. No <br /> back hauling of fill material will be permitted. <br />
