, 5/24/93 <br /> to: Zoning and Natural Resources Committee <br /> Dane County Board <br /> City-County Building #116 <br /> Madison WI 53709 <br /> copy: Dane County Community & Regional Planning Committee <br /> from: Pine Bluff citizen committee <br /> re: Zoning petition #5644, by John A Kassner, agent for Donald P Connors <br /> change zoning from A-1 exclusive agriculture district to R-1A <br /> residential district for purposes of splitting the existing property <br /> In the cited zoning petition, it is proposed to divide the existing 2.7 acre <br /> property described in his application into proposed parcel A, containing 1 .4 <br /> acres and the existing house, and, proposed parcel B, 1 .3 acres, on which the <br /> petitioner eventually plans to build an additional house. <br /> The undersigned residents of the Town of Cross Plains, whose properties adjoin <br /> the property under rezoning petition or are located on either side of the rock <br /> bluff, known as Pine Bluff, and located south of County Rd J and west and <br /> north of County Rd P, wish to bring to the attention of the Zoning and Natural <br /> Resources Committee of the Dane County Board our united opposition to the <br /> rezoning petition. <br /> As noted in the accompanying letter from the Town of Cross Plains to the Dane <br /> County Zoning Department and to the Dane County Community and Regional <br /> Development Commission, we all disagree with the earlier decision of the town <br /> board to approve the rezoning of the Connors property. <br /> In addition, with the exception of one of the resident families of our group, <br /> none of us had any prior knowledge that the rezoning decision was on the <br /> agenda for the Cross Plains Town Board for any of the earlier meetings; unlike <br /> county-level rezoning hearings, for which specific notices are mailed to <br /> property owners adjoining the one covered by the rezoning petition, the town <br /> boards are required only to post notifications in newspapers or on the doors <br /> of some public place such as the town hall; we deem this insufficient and <br /> unfair for purposes of generating appropriate and timely response from <br /> neighboring and affected property owners, and we feel that it invalidates <br /> rezoning decisions by township boards that provide no direct notification. <br /> We individually assign one or more reasons for opposing the rezoning: <br /> 1 . Proposed parcel B is highly unsuitable for building construction of any <br /> type, because most of its 1 .3 acres are on the steep (40-45 degree) north <br /> slope of the porous sandstone bluff (Pine Bluff) that transects all the <br /> properties south of County Rd J and west and north of County Rd P. There are <br /> three existing single-family houses, wells and septic systems located around <br /> the site at the base of the north slope of the bluff or near the intersection <br /> of County Rd J and County Rd P, comprising 4165 County Rd J (Wolf), 4175 <br /> County Rd J (Connors), and 4177 County Rd J (Schmid). These houses are each <br /> sited approximately 200 ft from each other. An additional septic system would <br /> negatively affect the wells of the houses on the south slope of the sandstone <br /> bluff, comprising 3427 County Rd P (Harris), 3425 County Rd P (Cade) and 3423 <br /> County Rd P (Willis). <br /> 1 <br />
