Although petitioners expect their buyer to close despite <br /> the delay, it is possible that the deal would fall <br /> through . If it does , petitioners will seek another <br /> buyer who will wish to use the property in some similar <br /> though not identical way to the current buyer . <br /> Accordingly, the owners would accept , if necessary, a <br /> restriction of use of Lot 1 to a carpet store but would <br /> prefer that the restriction be simply removed entirely <br /> as that would enhance marketability and the area has now <br /> developed in the manner the Town Board wished . <br /> Restrictions serve a useful purpose to ensure that <br /> initial development is desireable but in later years <br /> they adversely affect the marketability of land , <br /> reducing the price to the seller and adversely affecting <br /> the tax base . Accordingly, petitioners ask for outright <br /> removal of use limitations on Lots 1 and 2 , and ask that <br /> the County and Town rely on the regulations contained in <br /> the C -2 zoning section . <br /> Finally, petitioners seek to rezone of the portion <br /> of Lot 2 CSM 7040 where their house is located . <br /> Petitioners are not seeking to make a separate lot but <br /> only to have two different zones on one lot . House <br /> insurance would be less for petitioners if they were not <br /> living on land with commercial zoning .
