Likas <br /> Dear Colonel Baldwin: <br /> In response to your request of August 2, 1989, the U.S. Environmental <br /> Protection Agency (U.S. EPA) has reviewed the above referenced Public <br /> Notice. The applicant requested a Section 404 permit to discharge fill <br /> material into a wetland located above the headwaters of a tributary to Door <br /> Creek and the Yahara River, Dane County, Wisconsin. Two acres of the site <br /> have already been filled and an additional 13 acres would be impacted by the <br /> proposed project. U.S. EPA objects to the issuance of a permit for this <br /> action for the following reasons. <br /> The purpose of the project is to create an area which can support future <br /> commercial development. This is not a water dependent activity. In <br /> addition, there is no dernnstration of practicable alternatives, as required <br /> by 40 CYR Part 230.10(a) . The alternatives analysis should demonstrate that <br /> all efforts have been made to avoid the wetland area. If it is not possible <br /> to avoid the wetlands, then impacts must be minimized to the greatest extent <br /> possible. . Mitigation should only be employed as a last resort. <br /> Furthermore, Dane County is a developing urban area and has been <br /> experiencing wetland losses as a result of this increased development. We <br /> are therefore concerned with the cumulative impact of this project on the <br /> wetland resources of the County. <br /> For the above stated reasons, U.S. EPA recommends denial of this permit and <br /> restoration of the site.
