On
12/11/2012 conditional use permit 2223 for an extension of 10 years was approved by the Town of Oregon and Dane
County.
The Village of Brooklyn would like to share the following concerns it has with the Proposed CUP 2334.
1. With this new CUP 2334,the Village's concern is that this is an extension that will not expire for 25 to 30 years
without closure of the original pit. The length of 30 years is an excessive length of time. This extension would
create a CUP that has continued since 2004 without reclamation of the original pit.
2. In the CUP there is reference to a private well protection bond and claims procedure being included. The Village
of Brooklyn has a public well within 1000 feet of the original pit, and if there is a private well protection, there
should also be a protection for the Village well within this area.
3. Payne and Dolan sent the Village brief notice of this conditional use permit and not a complete application for
the Village to review.
4. CUP 1916 refers to hours of operation starting at 7am to 6pm weekdays but hauling times would be restricted to
between 8:30am and 5pm. In CUP 2334 these hours have been changed to 6am to 7pm during weekdays and
6am to 3pm on Saturdays with hauling times of 7am to 6pm weekdays and 7am to 3pm on Saturday. The Village
opposes these hours of operation and hauling times because of the close proximity to residential property.
5. Mr. Buglass from Payne & Dolan stated at a hearing before the Town of Oregon that there is currently a 10-foot
berm on the original Klahn pit and that will be reduced to a two-foot berm as part of the reclamation process.
The Village is opposed to changing the height of the berm. * t ti. &
iJY
Sincere) i s=aw : 2 . 41 Y" 6
by Y t
a. MAR 212016
Pat Hawkey
Village President
ice; 4
1, .,c,', `i i 'u'1.Ni t ti, tr , .i«.} i. ,
