I � • ORDINANCE AMENDMENT NO. 5219 Amending Section 10.03 relating to Zoning Districts in the Town of BLACK EARTH The Dane County Board of Supervisors does ordain as follows: That the Zoning District Maps of the Town of Black Earth be amended to include in the RH-4 Rural Homes District the following described land: Part of the SW 1/4 SE 1/4 Section 36, Town of Black Earth described as follows: Beginning at the South quarter corner of said Section 36; thence S 87° 10' 16" West, 1322.47 feet; along the South line of the SE 1/4 SW 1/4 of said Section 36; thence 02° 38' 31" West, 1105.69 feet along the West line of the SE 1/4 SW 1/4 of said Section 36; thence N 87° 10' 16" East, 517.33 feet; thence S 89° 04' 43" East, 236.06 feet; thence S 74° 39' 50" East, 305.45 feet; thence S 65° 26' 04" East, 270.26 feet; thence S 14° 27' 26" East, 58.54 feet; thence S 49° 21' 42" East, 116.08 feet; thence S 78° 20' 46" East, 158.46 feet; thence N 46° 41' 01" East, 150.29 feet; thence N 40° 10' 41" East, 110.83 feet; thence N 34° 20' 50" East, 162.22 feet; thence N 44° 03' 08" East, 416.19 feet; thence N 46° 47' 48" East, 99.71 feet; thence N 55° 55' 18" East, 113.01 feet; thence 63° 59' 01" East, 145.44 feet; thence N 46° 03' 44" East, 64.48 feet; thence N 26° 00' 00" East, 94.43 feet to a point in the centerline of CTH KP; thence S 68° 52' 00" East, 456.52 feet along the centerline of CTH KP to the point of curvature of a curve to the left having a central angle of 20° 43' 00" and a radius of 763.94 feet; thence Southeasterly, 276.22 feet along the arc of the curve to the point of tangency thereof, said arc also being the centerline of CTH KP, the long chord of which bears S 79° 13' 30" East, 274.72 feet; thence S 89° 35' 00" East, 573.77 feet along the centerline of CTH KP; thence S 88° 48' 00" East, 196.42 feet along the centerline of CTH KP to a point of the East line of the SE 1/4 SE 1/4 of said Section 36; thence S 02° 13' 10" East, 1302.84 feet along the East line of asid SE 1/4 SE 1/4 to the Southeast corner of said Section 36; thence S 87° 19' 46" West, 2634.90 feet along the South line of the SE 1/4 of said Section 36 to the point of beginning. CONDITIONAL ZONING Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) of the Dane County Code of Ordinances. The rezoned area shall be subject to the following conditions. DEED RESTRICTION REQUIRED This amendment will be effective, if within 90 days of its adoption by Dane County the owner or owners of the land shall record the following restrictions on said land: A. An Erosion Control Permit shall be obtained and implemented prior to the construction of any buildings on the above listed property. Said restrictions shall run in favor of Dane County and the pertinent Town Board as well as the owners of the land. Failure to record the restrictions will cause the rezone to be null and void.
