, , February 24th, 1992 <br /> ATTN: SHARP BISGARD,CHAIR <br /> DANE COUNTY ZONING COMMITTEE <br /> CITY-COUNTY BUILDING <br /> 210 MARTIN LUTHER KING JR BLVD <br /> MADISON,WIS 53709 <br /> RE Petition 5239 to Correct 5093 Limitation <br /> The petition 5093 was applied for in June of 91 and was <br /> approved in August of 91 with a condition placed upon it by <br /> the Board that required access in a location that the Town <br /> Board had not intended. <br /> It was the Town Board desire to limit any future developement <br /> access to Oak Park via a future street location at the North <br /> line of the two lot CSM. Further would help correct a chronic <br /> surface water problem for the property owners located <br /> Southerly of the two lot CSM and would provide that the <br /> surface water would again flow Westerly thru the existing <br /> Town culvert across Oak Park Road. This was the way waters <br /> had drained since the last glacial period. <br /> We re-filed in January 92 under petition # 5239 to correct <br /> this approval language restriction. The CSM was recorded. <br /> On the day of the public hearing on Feb. 11, 92 an objection <br /> was presented thru an Attorney,a Mr . Burrows out of Edgerton, <br /> Wisc. <br /> The essence of which is was to object to having water run <br /> across the lands he had just acquired from this petitioner . <br /> It must be noted that the principals have been neighbors for <br /> many years. Mr . Neath offered to buy this 80 acres in July of <br /> 91 and agreed to the fact that this land use change would <br /> increase water flows see both his contract and on the deed of <br /> sale. <br /> The fact that the Town held two plan meetings and two board <br /> actions and the County sent him notices evidently was not <br /> enough notice until the last moment to present his concerns . <br /> The fact remains the Town wants to resolve a chronic water <br /> problem as created by a SCS water diversion berm some 10-12 <br /> years ago. Prior to that time water always ran westerly,and <br /> the Town wants to have the Petitioner correct this problem <br /> and pay to replace the old cross culvert on Oak Park Rd. as a <br /> condition of approval . This the Petitioner has agreed to do . <br /> Further it should be noted that two homes on 8 acres will not <br />
