Dane County Zoning Department
February 10, 1992
Page Two
2 . That a waterway be constructed across the Neath
property to the existing ditch.
3. That the existing ditch be cleaned to be able to
accommodate the increased flow.
4 . That a culvert be constructed across the drainway to
allow Neath access to his Southerly field with the
water flowing straight across the property and exiting
in the Southwest rather than backing up through the
existing drainways constructed on that property. I am
enclosing a map for your review which shows what needs
to be done for the construction.
We would recommend that the Committee postpone action on this
decision until the above conditions can be met.
If any damages are caused to Mr. Neath's crop from the diversion
of the natural waterway, Mr. Neath will have a cause of action
against the property owners that diverted the water. We want to
avoid this potential by proper planning and engineering at the
outset.
If there are any questions concerning this correspondence, please
do not hesitate to contact me.
Respectfully sub l 'tted,
ROETHE, BUHR, , • aETHE & POPE
Je l . •l ethe
kp
en s.
pc John and Marilyn Neath (w/encls. )
Attorney Dona Merg (w/encls. )
Fred Nelson (w/encls. )
Walter Olson (w/encls. )
Lyman Anderson (w/encls. )
