a <br /> A ORDINANCE AMENDMENT NO. 5261 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of <br /> COTTAGE GROVE <br /> The Dane County Board of Supervisors does ordain as follows: That the <br /> Zoning District Maps of the Town of Cottage Grove be amended to include in the <br /> R-1A Residential District the following described land: <br /> Part of the S 1/2 NE 1/4 Section 24, Town of Cottage Grove described as <br /> follows: Commencing at the Northeast corner of Dane County Certified Survey <br /> Map 3974 of Certified Surveys, thence S 00° 03' 39" East along the East line of <br /> said Certified Survey, 187.46 feet to the point of beginning; thence N 71° 21' <br /> 04" East, 237.61 feet; thence N 00° 12' 11" West, 125.21 feet; thence N 89° 47' <br /> 49" East, 200.00 feet; thence S 00° 12' 11" East, 200.00 feet; thence S 89° 47' <br /> 49" West, 200.00 feet; thence N 00° 12' 11" West, 40.00 feet; thence S 71° 21' <br /> 04" West, 237.70 feet to the aforesaid East line of CSM 3974; thence N 00° 03' <br /> 39" West, 34.82 feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) <br /> of the Dane County Code of Ordinances. The rezoned area shall be subject to <br /> the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed description/s is/are intended to describe land for which a <br /> certified survey map will be prepared for approval and recorded. This <br /> amendment will become effective, if within 90 days of its approval by Dane <br /> County, a certified survey map that describes the land to be rezoned is <br /> recorded in the office of the Dane County Register of Deeds. Failure to <br /> record the survey will cause the rezone to be null and void. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane <br /> County the owner or owners of the land shall record the following restrictions <br /> on the balance of the land from which the rezone area is taken: <br /> A. Residential use is prohibited. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town <br /> Board as well as the owners of the land. Failure to record the restrictions <br /> will cause the rezone to be null and void. <br /> EFFECTIVE DATE: JUL 1 5 1992 <br />
