RESTRICTIONS <br /> 1. WHEREAS, is/are <br /> the owner/s of the following described land in the Town of <br /> Dane County, Wisconsin, to-wit: <br /> Part of the S 1/2 NE 1/4 Section 24, Town of Cottage Grove described as <br /> follows: Commencing at the Northeast corner of Dane County Certified Survey <br /> Map 3974 of Certified Surveys, thence S 00° 03' 39" East along the East line <br /> of said Certified Survey, 187.46 feet to the point of beginning; thence N 71° <br /> 21' 04" East, 237.61 feet; thence N 00° 12' 11" West, 125.21 feet; thence N <br /> 89° 47' 49" East, 200.00 feet; thence S 00° 12' 11" East, 200.00 feet; thence <br /> S 89° 47' 49" West, 200.00 feet; thence N 00° 12' 11" West, 40.00 feet; thence <br /> S 71° 21' 04" West, 237.70 feet to the aforesaid East line of CSM 3974; thence <br /> N 00° 03' 39" West, 34.82 feet to the point of beginning. <br /> 3. NOW, THEREFORE, in consideration of the mutual benefits passing to and <br /> from the owner and those who may hereafter purchase said land and the <br /> parties named as beneficiaries of these restrictions, the following <br /> restrictions are hereby imposed: <br /> A. Residential use is prohibited. <br /> These restrictions shall constitute covenants running with the land and <br /> shall be binding upon all parties now owning any part of said land, their <br /> successors, heirs and assigns, and all parties holding under them unless, <br /> pursuant to paragraphs 5 or 6 of this instrument, said restrictions are <br /> amended or terminated. <br /> 4. The restrictions provided for herein shall be enforceable at law or <br /> equity against any party who has or acquires an interest in the land <br /> subject to the restriction by the following parties who are named as <br /> grantees, promisees and beneficiaries with enforcement rights: <br /> (a) The County Government of Dane County, Wisconsin provided that the <br /> lands are under the jurisdiction of zoning ordinance of said County <br /> at the time the enforcement action is commenced; and <br />
