ORDINANCE AMENDMENT NO. 5271 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of <br /> PERRY <br /> The Dane County Board of Supervisors does ordain as follows: That the <br /> Zoning District Maps of the Town of Perry be amended to include in the RH-2 <br /> Rural Homes District the following described land: <br /> Part of the SE 1/4 NE 1/4 and NE 1/4 SE 1/4 Section 23, Town of Perry described <br /> as follows: Beginning at the East quarter corner of said Section 23; thence <br /> West, 33.00 feet; thence South parallel with the East line of Section 23, <br /> 497.36 feet to the centerline of CTH A; thence N 85° 26' West along said <br /> centerline, 388.56 feet; thence N 68° 05' West along said centerline, 258.34 <br /> feet; thence North, 1030.00 feet; thence East, 660.00 feet to the East line of <br /> Section 23; thence South, 660.00 feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) <br /> of the Dane County Code of Ordinances. The rezoned area shall be subject to <br /> the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed description is intended to describe land for which a <br /> certified survey map will be prepared for approval and recorded. This <br /> amendment will become effective, if within 90 days of its approval by Dane <br /> County, a certified survey map that describes the land to be rezoned is <br /> recorded in the office of the Dane County Register of Deeds. Failure to <br /> record the survey will cause the rezone to be null and void. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane <br /> County the owner or owners of the land shall record the following restrictions <br /> on said land: <br /> A. The residences shall be located as shown on the site plan which was <br /> approved by the town. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town <br /> Board as well as the owners of the land. Failure to record the restrictions <br /> will cause the rezone to be null and void. <br /> CONDITIONS: <br /> 1. The certified survey may not create more than 2 parcels. <br /> 2 A soil erosion control plan is required for construction of buildings if <br /> deemed necessary by the Zoning Administrator. <br /> EFFECTIVE DATE: NAY 2 2 1992 <br />
