ORDINANCE AMENDMENT NO. 5238 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of • ' <br /> PERRY <br /> The Dane County Board of Supervisors does ordain as follows: That the <br /> Zoning District Maps of the Town of Perry be amended to include in the RH-i <br /> Rural Homes District the following described land: <br /> Part of the SW 1/4 NW 1/4 Section 32, Town of Perry described as follows: <br /> Commenicng at the West quarter corner of Section 32; thence East 470.00 feet <br /> along the East-West quarterline; thence N 09° 00' West 245 feet to the point of <br /> beginning. Thence S 81° 00' East 700 feet; thence N 09° 00' East 225 feet; <br /> thence N 81° 00' West 700 feet; thence S 09° 00' West 225 feet to the point of <br /> beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) <br /> of the Dane County Code of Ordinances. The rezoned area shall be subject to <br /> the following conditions. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane <br /> County the owner or owners of the land shall record the following restrictions <br /> on said land: <br /> A. The residence must be located in the Eastern 1/2 of the 3.6 acres <br /> included in this rezone. <br /> B. An erosion control plan shall be submitted to the Town Board for <br /> approval prior to construction of any buildings on this site. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town <br /> Board as well as the owners of the land. Failure to record the restrictions <br /> will cause the rezone to be null and void. <br /> CONDITION: <br /> 1.
