• MUTUAL AGREEMENT <br /> • <br /> Whereas, Barry M. and Denise G.Miller(Miller) are the owners of real estate at 3941 <br /> Hwy 19,DeForest,WI(Town of Burke) and whereas, Constance D. Gerstner <br /> (Gerstner) is the owner of Malagold Kennels at 3953 Hwy 19,DeForest,WI(Town of <br /> Burke). <br /> Miller and Gerstner have viewed the North property line of Miller and South property <br /> line of Gerstner and agree as follows: <br /> 1. Gerstner has agreed to construct a wood, board-on-board, fence(sight <br /> prohibiting), which shall be six (6) feet high, beginning at the westerly end of the <br /> existing chain link fence and running East approximately two hundred forty (240) <br /> feet to the top of the knoll, then the fence shall be eight(8)feet from that point <br /> until the easterly end of the existing chain link fence, where it will turn South to <br /> follow the existing chain link fence, continuing at a height of eight (8) feet for a <br /> distance of approximately thirty (30)feet. The fence shall follow the line of the <br /> existing chain link fence along the Gerstner North and Miller South boundary. <br /> 2. Gerstner shall install a six (6)foot wood board fence along the North and East <br /> end of the Golden Retriever paddock. <br /> 3. Gerstner shall obtain bids and enter into a contract for installation of the boarding <br /> and fencing within 15 days of March 24, 1993 or sooner. Construction of the <br /> fence shall commence when the fencing company can accomplish, weather <br /> permitting. <br /> 4. In the event the outside telephone is too loud the Millers shall contact Gerstner <br /> and the telephone will be toned down. <br /> 5.
