ORDINANCE AMENDMENT NO. 5335 <br /> • <br /> Amending Section 10.03 relating to Zoning Districts in the Town of <br /> BLUE MOUNDS <br /> The Dane County Board of Supervisors does ordain as follows: That the <br /> Zoning District Maps of the Town of Blue Mounds be amended to include in the <br /> RH-4 Rural Homes District the following described land: <br /> Part of the SW 1/4 and also part of the SE 1/4 SW 1/4 of Section 31, Town of <br /> Blue Mounds described as follows: Commencing from West one quarter corner of <br /> Section 31 S 41° 00' 24" East, 1749.64 feet; thence N 89° 51' 19" East 916.5 <br /> feet to the point of beginning; thence S 11° 52' 50" East 251.68 feet; thence S <br /> 30° 29' 43" East 199.24 feet; thence S 47° 07' 02" West 106.82 feet; thence S <br /> 83° 00' 34" West 559.15 feet; thence N 61° 52' 05" West 256.33 feet; to the <br /> Northerly right-of-way of Barber Road; thence Southerly and Easterly along said <br /> North right-of-way line to the East line of the SE 1/4 SW 1/4; thence N 00° 27' <br /> 13" East 1299 feet; thence S 89° 51' 19" West 474.0 feet to the point of <br /> beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) <br /> of the Dane County Code of Ordinances. The rezoned area shall be subject to <br /> the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed description is intended to describe land for which a <br /> certified survey map will be prepared for approval and recorded. This <br /> amendment will become effective, if within 90 days of its approval by Dane <br /> County, a certified survey map that describes the land to be rezoned is <br /> recorded in the office of the Dane County Register of Deeds. Failure to <br /> record the survey will cause the rezone to be null and void. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane <br /> County the owner or owners of the land shall record the following restrictions <br /> on said land: <br /> A. Only one residence is allowed. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town <br /> Board as well as the owners of the land. Failure to record the restrictions <br /> will cause the rezone to be null and void. <br /> CONDITION <br /> The location of the driveway access to the property shall be subject to Town <br /> Board approval and shown on the certified survey. <br /> EFFECTIVE DAT' . , ?, <br /> II I <br />
