WHEREAS, is/are <br /> the owner/s of the following described land in the.Town of <br /> Dane County, Wisconsin, to-wit: <br /> Part of the SW 1/4 and also part of the SE 1/4 SW 1/4 of Section 31, Town of <br /> Blue Mounds described as follows: Commencing from West one quarter corner of <br /> Section 31 S 41° 00' 24" East, 1749.64 feet; thence N 89° 51' 19" East 916.5 <br /> feet to the point of beginning; thence S 11° 52' 50" East 251.68 feet; thence <br /> S 30° 29' 43" East 199.24 feet; thence S 47° 07' 02" West 106.82 feet; thence <br /> S 83° 00' 34" West 559.15 feet; thence N 61° 52' 05" West 256.33 feet; to the <br /> Northerly right-of-way of Barber Road; thence Southerly and Easterly along <br /> said North right-of-way line to the East line of the SE 1/4 SW 1/4; thence N <br /> 00° 27' 13" East 1299 feet; thence S 89° 51' 19" West 474.0 feet to the point <br /> of beginning. <br /> 3. NOW, THEREFORE, in consideration of the mutual benefits passing to and <br /> from the owner and those who may hereafter purchase said land and the <br /> parties named as beneficiaries of these restrictions, the following <br /> restrictions are hereby imposed: <br /> A. Only one residence is allowed. <br /> These restrictions shall constitute covenants running with the land and <br /> shall be binding upon all parties now owning any part of said land, their <br /> successors, heirs and assigns, and all parties holding under them unless, <br /> pursuant to paragraphs 5 or 6 of this instrument, said restrictions are <br /> amended or terminated. <br /> 4. The restrictions provided for herein shall be enforceable at law or <br /> equity against any party who has or acquires an interest in the land <br /> subject to the restriction by the following parties who are named as <br /> grantees, promisees and beneficiaries with enforcement rights: <br /> a) . The County Government of Dane County, Wisconsin provided that the lands <br /> are under the jurisdiction of Zoning Ordinance of said County at the <br /> time the enforcement action is commenced; and <br />
