ORDINANCE AMENDMENT NO. 5305 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of <br /> DUNKIRK <br /> The Dane County Board of Supervisors does ordain as follows: That the <br /> Zoning District Maps of the Town of Dunkirk be amended to include in the RH-2 <br /> Rural Homes District the following described land: <br /> Part of the SW 1/4 NW 1/4 Section 28, Town of Dunkirk described as follows: <br /> Beginning at the West quarter corner of said Section 28; thence North 458 feet; <br /> thence East 580 feet; thence South 145 feet; thence East 160 feet; thence South <br /> 247 feet; thence East 571.4 feet; thence South 66 feet; thence West 1311.4 feet <br /> to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) <br /> of the Dane County Code of Ordinances. The rezoned area shall be subject to <br /> the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed description is intended to describe land for which a <br /> certified survey map will be prepared for approval and recorded. This <br /> amendment will become effective, if within 90 days of its approval by Dane <br /> County, a certified survey map that describes the land to be rezoned is <br /> recorded in the office of the Dane County Register of Deeds. Failure to <br /> record the survey will cause the rezone to be null and void. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane <br /> County the owner or owners of the land shall record the following restrictions <br /> on said land: <br /> A. Only one residence and one accessory building may be constructed on <br /> the property. The accessory building may not be more than 576 <br /> square feet in floor area. <br /> B. A total of not more than 1/2 acre (21,780 square feet) of land may <br /> be used for the residence and accessory building. <br /> C. Clear-cutting or substantial cutting of the wooded area requires <br /> approval of the Town Board. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town <br /> Board as well as the owners of the land. Failure to record the restrictions <br /> will cause the rezone to be null and void. <br /> EFFECTIVE DATE / Wi a 1992, <br />
