t <br /> MINUTES OF THE MEETING OF THE DANE COUNTY <br /> BOARD OF ADJUSTMENT <br /> 41,46 COMMITTEE HELD ON December 20, 1990 <br /> The following members were present: Kruschke, Quackenbush, Arts and Rendall. <br /> Also: Reynolds and Fleck. <br /> Meeting called to order at 7:00 P.M. in Room #2-D City-County Building by <br /> Chairman Kruschke to hold public hearing as published by Class II Notice. <br /> Quackenbush/Arts to approve minutes of 11/29/90 and 12/18/90. Motion carried <br /> - 3-0. <br /> #2071. Appeal by Richard & Rita Olson for a variance from required rearyard <br /> as provided by Sections 10.05(8) and 10.16(6)(b)3 to permit a deck addition to <br /> residence as constructed at 5582 Sheil Drive being Lot #3, Hillcrest Heights, <br /> - Section 16, Town of Oregon. <br /> IN FAVOR: R. Olson OPPOSED: --- COMMUNICATION: Town Board. <br /> Quackenbush/Rendall to deny requested variance from required rearyard to <br /> permit deck as constructed. <br /> FINDING OF FACT: <br /> 1). Deck is a reconstruct and enlargement of former deck in excess of <br /> original dimension. <br /> 2). Applicant utilized erroneous lot line in determining rearyard distance. <br /> 3). Ordinance allows deck to intrude 12 feet into required rearyard with <br /> uncovered deck. <br /> (be CONCLUSION: <br /> 1). Unnecessary hardship was not proven. Motion carried - 4-0. <br /> #2072. Appeal by Walter Haack, agent for Gerald Haack for a variance from <br /> required setback from road as provided by Section 10.17(3)(b) to permit silo <br /> as constructed at 4235 Garfoot Road in the SW 1/4 SE 1/4 - Section 8, Town of <br /> Cross Plains. <br /> IN FAVOR: W. Haack OPPOSED: --- COMMUNICATION: -- <br /> Rendall/Quackenbush to grant variance of 31.5 feet more or less from required <br /> setback to centerline of Garfoot Road to permit silo construction. <br /> FINDING OF FACT: <br /> 1). Similar variances granted for (2) existing silos. <br /> 2). Foundation was poured then construction halted pending variance. <br /> 3). Alternative locations not feasible for efficient farm operation. <br /> CONCLUSION: <br /> 1). Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> 2). Variance is not contrary to rights of others or to the public interest. <br /> Motion carried - 4-0. <br /> #2073. Appeal by Edward Hefty for a variance from required setback from road <br /> as provided by Section 10.17(5) to permit single family residence as <br /> constructed at 5568 Ralph Road being Lot #22, Hillcrest Heights, 1st Addition <br /> - Section 16, Town of Oregon. <br /> -11C41.1.111 <br /> - <br />
