BOA MINUTES/9/27/90 <br /> Page 5 <br /> CONDITIONS: <br /> 1). That plans and specifications be prepared by a licensed engineer within <br /> the scope of the application, and filed with the Zoning Department before <br /> commencement of any work. <br /> 2). That all work be performed in compliance with approved engineering <br /> standards and all applicable governmental rules and regulations particularly <br /> Section 11.05(4) of Dane County Ordinance. <br /> 3). That there be filed with the Zoning Department a certificate of <br /> compliance by a licensed engineer at the completion of the project. <br /> FINDING OF FACT: <br /> 1). Engineering data forthcoming from engineer will give specific details of <br /> landscaping and retaining walls. <br /> 2). Project is for minimal earth disburbance and basically a restoration and <br /> stabilization of an existing situation. <br /> CONCLUSION: <br /> 1). The project as planned, with specified conditions; will not result in <br /> substantial detriment to navigable waters by erosion, sedimentation, <br /> impairment of fish or aquatic life, or safe and healthful conditions. <br /> Motion carried - 4-0. <br /> Quackenbush/Rendall to hold in abeyance boathouse setback variance pending <br /> engineers' determination of normal high watermark and setback violation if any. <br /> Motion carried - 4-0. <br /> Also, Quackenbush/Harvey to deny requested variances from setback to normal <br /> high watermark and left sideyard to allow steps and stoop as added to deck. <br /> 411", FINDING OF FACT: <br /> 1). Variance #1960 was granted to permit deck into required setback to normal <br /> high watermark. Applicant added stairs further into setback than permitted. <br /> 2). Originally steps were to be incorporated into permitted deck overall <br /> dimension. <br /> 3). Sideyard violation is step/pad, built without permit, that is correctable <br /> by re-design of step. <br /> CONCLUSION: <br /> 1). Unnecessary hardship was not proven. <br /> Motion carried - 4-0. <br /> #2038. Appeal by Eric C. Grimm for a variance from required setback from road <br /> as provided by Section 10.16(5) to permit additions to existing residence at <br /> 4180 High Street being Lot #17, Block 3, Greenridge Park - Section 9, Town of <br /> Dunn. <br /> IN FAVOR: E. Grimm OPPOSED: --- COMMUNICATION: Town Board <br /> Quackenbush/Harvey to grant variance of 6 feet from required setback to <br /> right-of-way of North Court to permit deck addition to residence as <br /> constructed. <br /> FINDING OF FACT: <br /> 1). Deck constructed under existing carport which was built prior to <br /> applicant owning the property. <br />
